Miranda Rights

By Anonymous (not verified) | 7:09 PM CST, Sat February 01, 2025
After placing the suspect under arrest, the officer will say something similar to, 鈥淵ou have the right to remain silent. Anything you say can and will be used against you in a court of law. You have a right to an attorney. If you cannot afford an attorney, one will be appointed for you." These warnings stem from the Fifth Amendment privilege against self-incrimination and the Sixth Amendment right to counsel.
It was determined that the police interrogation was invalid because the officers never explained what the defendant's Miranda rights are.
